1099-NEC vs MISC routing

Frequently asked questions

Is it really free?+

Yes — free with a watermark and 0 AI Deep Detect, then $8.99/mo Start for 8 AI Deep Detect/mo. No credit card required for the free plan.

Is my data safe?+

Yes — files are stored encrypted (AES-256 at rest) on EU servers, never used to train third-party AI. SOC 2 Type II controls. Sensitive identifiers (SSN, EIN) are masked in our staff console.

When do I file a 1099-MISC vs. a 1099-NEC?+

1099-NEC (Non-Employee Compensation, reintroduced in tax year 2020) — for $600+ paid in services to independent contractors, freelancers, gig workers — anything that used to go in old Box 7 of the 1099-MISC. 1099-MISC — for rents ($600+, Box 1), royalties ($10+, Box 2), prizes/awards (Box 3), attorney gross proceeds (Box 10), fishing-boat proceeds, medical/healthcare payments, and crop-insurance proceeds. The $600 contractor-payment trap: if you put service fees on a 1099-MISC instead of 1099-NEC, the IRS assesses a $310/form penalty. Source: IRS 1099-MISC Instructions.

What is the deadline to file 1099-MISC?+

Furnish to recipient — January 31 of the year following payment. File with IRS — February 28 (paper) or March 31 (electronic). E-filing is mandatory if you file 10+ information returns total (lowered from 250 in 2024). Source: 26 U.S.C. § 6041.

What are the penalties for late or incorrect 1099-MISC?+

Tiered under IRC §6721 (failure to file correct information return with IRS) and §6722 (failure to furnish correct payee statement), 2024 amounts per Rev. Proc. 2023-34 and IRS Form 1099 General Instructions. Filed within 30 days late: $60/form (annual cap $664,500 / $232,500 small business under §6724(d)). 30+ days late but before August 1: $130/form (annual cap $1,993,500 / $664,500). After August 1 or never filed: $330/form (annual cap $3,987,000 / $1,329,000). Intentional disregard: $660/form, no annual cap. Penalties stack — the §6721 IRS-copy penalty plus the §6722 recipient-copy penalty doubles each tier (the "double penalty" trap that Tax1099 and TaxBandits do not warn you about). State surcharges add another $50-$500 per missing 1099 (CA Form 593, NY Form IT-1099). iFillPDF computes the worst-case exposure before you file and routes you to e-file via IRIS to drop the §6724 reasonable-cause defense baseline.

Do I need to send the 1099-MISC to the IRS?+

Yes — Copy A goes to the IRS (paper via Form 1096 transmittal, or electronic via FIRE/IRIS). Copy B to the recipient. Copy C (and Copy 1 if your state requires) you keep.

Can I e-sign and e-file the 1099-MISC?+

Yes. The IRS accepts electronic filing through FIRE (legacy) and IRIS (new portal launched 2023). E-signature on the recipient copy is allowed under the ESIGN Act. iFillPDF generates both human-readable PDFs and IRIS-compatible CSV.
