Yes — a signed bill of sale is admissible evidence of ownership transfer in all 50 states under contract law and the UCC (Article 2, sale of goods). For vehicles, boats, and firearms, the state may also require a separate title transfer or registration step.

Do I need to notarize a bill of sale?+

It depends on your state and the asset. For motor vehicles, 16 states REQUIRE notarization: AL, AZ, GA, ID, LA, MD, MS, MT, NE, NV, NH, OH, OK, WV, WY. For boats: KS, MN, OK, PA. What does "AS-IS" mean on a bill of sale?+

"AS-IS WHERE-IS" is a contract-of-sale disclaimer authorized by Uniform Commercial Code §2-316(3)(a) (adopted in all 50 states except Louisiana, which uses LSA-C.C. art. 2474 redhibition equivalent) that defeats both the implied warranty of merchantability under UCC §2-314 (the goods are fit for the ordinary purpose) AND the implied warranty of fitness for a particular purpose under §2-315 (where the seller knew the buyer's specific need). The buyer accepts the item with every defect — known, unknown, latent, patent — and bears the inspection burden going forward. The seller remains liable only for active fraud (knowingly concealing a material defect, e.g. odometer rollback violating 49 USC §32703 + §32710 — civil penalty $11,182 per offense, 2024 NHTSA cap) or for breaches of express warranty made outside the document. Critical formatting rule: §2-316(2) requires the disclaimer to be CONSPICUOUS (10-pt bold uppercase or larger, contrasting color or font) — we auto-format. Example: a court in Bowdoin v. Showell Growers (Del. Super. 1979) struck a non-conspicuous AS-IS clause buried in 8-pt body copy and held the seller liable for $42K in defects. Can I sell a firearm with a bill of sale?+

Yes for INTRASTATE private sales (within your state) — most states allow this without an FFL dealer. For INTERSTATE sales (across state lines), federal law (18 USC § 922) requires the transfer go through a Federal Firearms Licensee (FFL). The buyer picks up at an FFL in their state, who runs the NICS background check. Our firearm template warns you of this.

Vehicle bill of sale — is it the same as a title?+

No. The TITLE is the official ownership document issued by your state DMV. The BILL OF SALE is a private contract proving the sale happened, the price, and the date. You need BOTH for the buyer to register the vehicle in their name. The bill of sale is also used to calculate sales tax owed at the DMV.

Can the buyer back out after signing the bill of sale?+

No, generally not — once both parties sign and money changes hands, the sale is final. Exceptions: fraud, misrepresentation of the asset (e.g. odometer rollback, hidden lien), or a written cooling-off clause you choose to add. Our template offers an optional 72-hour cooling-off clause.

How do I prove the sale price for taxes?+

The bill of sale IS the proof. Most state DMVs use it to calculate sales/use tax at registration (typically 4-7% of the sale price).
