What does "AS-IS" mean on a bill of sale?+
"AS-IS WHERE-IS" is a contract-of-sale disclaimer authorized by Uniform Commercial Code §2-316(3)(a) (adopted in all 50 states except Louisiana, which uses LSA-C.C. art. 2474 redhibition equivalent) that defeats both the implied warranty of merchantability under UCC §2-314 (the goods are fit for the ordinary purpose) AND the implied warranty of fitness for a particular purpose under §2-315 (where the seller knew the buyer's specific need). Yes for INTRASTATE private sales (within your state) — most states allow this without an FFL dealer. For INTERSTATE sales (across state lines), federal law (18 USC § 922) requires the transfer go through a Federal Firearms Licensee (FFL). Vehicle bill of sale — is it the same as a title?+
No. The TITLE is the official ownership document issued by your state DMV. The BILL OF SALE is a private contract proving the sale happened, the price, and the date. You need BOTH for the buyer to register the vehicle in their name. The bill of sale is also used to calculate sales tax owed at the DMV.
Can the buyer back out after signing the bill of sale?+
No, generally not — once both parties sign and money changes hands, the sale is final. Exceptions: fraud, misrepresentation of the asset (e.g. odometer rollback, hidden lien), or a written cooling-off clause you choose to add. Our template offers an optional 72-hour cooling-off clause.
