Which notice type do I need ?+

Three families. Pay or Quit — tenant owes back rent (CA CCP §1161 = 3 business days; OR ORS §90.394 = 72 hours after the 8th of the month; TX Prop §24.005 = 3 days). Cure or Quit — tenant breached a curable lease term such as unauthorized pet, noise, unauthorized occupant, minor property damage (typically 3-30 days depending on state). Unconditional Quit — conduct is uncurable: illegal drug activity, repeated material violations, threats, gang activity, controlled-substance manufacturing on premises (immediate vacate, no cure period — see CA CCP §1161(4) and most state forcible-entry statutes). How many days do I have to give the tenant ?+

It depends on the state and notice type. California : 3 business days for non-payment (CCP § 1161). New York : 14 days (RPAPL § 711). Texas : 3 days (Property Code § 24.005). Some states require longer notice for tenants who have lived there 1+ year. The Wizard sets the deadline based on your inputs.

Can I just change the locks if the tenant won’t leave ?+

No — never. Self-help eviction is illegal in all 50 states and exposes you to damages, attorney’s fees, and in some states criminal charges. If the tenant doesn’t leave by the deadline, file an unlawful detainer (or summary process / forcible entry and detainer) action in your local civil or housing court.

Is the federal CDC eviction moratorium still in effect ?+

No. The CDC moratorium issued under 42 USC §264(a) was struck down by the US Supreme Court in Alabama Ass'n of Realtors v. HHS, 594 U.S. 758 (Aug 26, 2021) — the Court held the CDC exceeded its statutory authority and only Congress can authorize a national moratorium. There is no current federal moratorium, but residual local protections may apply: NYC ERAP-pending stays under Real Property Law §232-b, LA County COVID-19 Tenant Protections Resolution (sunset), Seattle SMC §22.205 winter eviction ban (Dec 1-Mar 1), and several California "just cause" overlays under AB-1482 (CA Civ. Code §1946.2) capping no-fault terminations. The Wizard checks county-level overlays before generating the notice — a layer that eForms, FormSwift and LegalTemplates do not run.

Do I need to give a reason for the eviction ?+

In most states, you must state the cause for cause-based notices (non-payment, violation, illegal activity). For month-to-month tenancies in some "no-cause" states, a 30 or 60-day notice without cause is allowed — but California (AB 1482), Oregon (SB 608), New Jersey, and several cities require just cause for all evictions.
